The jury system, by which most serious offenses are tried, creates a balance in its factfinding process between lay standards of judgment and judicial practices. This study explicates three main principles by which these practices are governed: the desire to discover the truth, protection of the innocent from convictionincluding theories of proof of reasonable doubt and prejudicial evidenceand maintenance of standards of propriety.
